PREAMBLE
1. The brand Honrado Vineyards and the online store.honrado.pt are owned by Honrado Vineyards LDA, NIPC 514325283, with headquarters at Rua General Humberto Delgado, 17, 7960-446 Vila de Frades.
2. These General Conditions of Online Sale are agreed between Honrado Vineyards, Ltd., hereinafter referred to as "Honrado" and persons wishing to make purchases through the online store www.honrado.pt, hereinafter referred to as "Customer".
3. These conditions shall apply exclusively to natural persons who are not traders, being understood as such any natural person acting for purposes which are outside the scope of his professional activity.
4. The parties agree that purchases made through the online store www.honrado.pt shall be governed exclusively by this contract to the exclusion of any conditions previously available on the website.
5. These General Conditions of Online Sale may be changed without prior notice and should therefore be consulted before placing any order.
ARTICLE 1 - OBJECT
1. The purpose of these General Conditions of Online Sale is to provide and define all necessary information to the Customer about the types of order, sale, payment and delivery of purchases made at Honrado.
2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties.
3. These general conditions shall not apply if it is found, by the type of order, that the Customer is not a final consumer as defined in paragraph c) of Article 3 of Decree-Law No. 24/2014 of 14 February.
4. Any and all alcoholic beverages available for sale may not Honrado be purchased by persons other than those of legal age in their country of residence.
ARTIGO 2 – INFORMAÇÃO DE PRODUTOS, PREÇOS, CONTEÚDOS, E ALERGÉNIOS
1. Under current Portuguese legislation, the prices shown in the Honrado are in Euros and include the respective VAT rates in force.
2. A Honrado reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding its products, prices, promotions, commercial conditions and services.
3. All products presented in this website Honrado are subject to stock availability.
4. All information and content present in the online store www.honrado.pt and its subdomains, are property of the brand Honrado and its use, reproduction, copy and dissemination by other means of texts, logos, images and videos present in the online store www.honrado.pt, subject to their prior authorization.
5. De acordo com o Regulamento (UE) n.º 1169/2011, do Parlamento Europeu e do Conselho, de 25 de Outubro de 2011, informamos os nossos clientes das SUBSTÂNCIAS OU PRODUTOS QUE PROVOCAM ALERGIAS OU INTOLERÂNCIAS: Cereais que contêm glúten; Crustáceos e produtos à base de crustáceos; Ovos e produtos à base de ovos; Peixes e produtos à base de peixe; Amendoins e produtos à base de amendoins; Soja e produtos à base de soja; Leite e produtos à base de leite; Frutos de casca rija, nomeadamente amêndoas, avelãs, nozes, entre outros; Apo e produtos à base de aipo; Mostarda e produtos à base de mostarda; Sementes de sésamo e produtos à base de sementes de sésamo; Dióxido de enxofre e sulfitos em concentrações superiores a 10 mg/kg ou 10 mg/l em termos de SO2; Tremoço e produtos à base de tremoço; Moluscos e produtos à base de moluscos. ARTICLE 3 - ORDER
1. The Customer places his order through the online shop of Honrado, selecting the items from the online catalogue presented and through the following process: a) Proceed to the registration in the online shop of Honrado, providing for this purpose the information requested there (name, address of delivery and billing, as well as the NIF, which for tax purposes, want to appear on the invoice) and read the General Conditions of Online Sale contained in the online shop www.honrado.pt; b) Add to the shopping cart the products you want to order; c) Finish the order by filling in the requested fields; d) Proceed to the payment of your order with the payment method selected, after receiving it in our system, your order will be processed and sent and you will receive our order confirmation and shipping notifications.
2. The orders will only be processed after the effective confirmation of your payment, the order itself does not constitute a reservation of the products.
3. All orders have a maximum payment term of 48 hours. After this deadline, the order will be automatically cancelled.
4. The data contained in the invoice is the entire responsibility of the Customer. The invoice once issued cannot be reissued with alterations.
5. If the Customer is Honrado unable to supply the order in part or in whole, the Customer will be contacted immediately in order to find a suitable solution to the situation.
6. A Honrado reserves the right to cancel orders that lead to incorrect amounts due to computer errors, returning the amounts paid immediately to its customers.
7. O limite máximo de garrafas por encomenda na Honrado são 30 unidades para envios para Portugal Continental, 18 unidades para países da União Europeia e 6 unidades para os restantes destinos, para encomendas de quantidades superiores entre em contacte-nos através do email [email protected]
ARTIGO 4 – MEIOS DE PAGAMENTO E PROMOÇÕES EM VIGOR
1. A makes Honrado available to its Customers the means of payment presented when checking out the shopping cart.
2. A Honrado reserves the right to cancel any order whose validation of payment by any means raises doubts or reservations.
3. A campanha "Oferta de 1 garrafa de Vinho de Talha para novos clientes da loja online" entrou em vigor dia 4 de Maio de 2020 e estará disponível online até 15 de Agosto de 2020. Campanha disponível ao stock existente.
4. A campanha mencionada no ponto 3. do Artigo 4 sofreu uma extensão de 30 dias, estando neste momento válida até dia 15 de Outubro de 2020. A campanha poderá estar mais alguns dias online até terminar o stock existente, reservando a empresa o direito de retirar a mesma do ar a qualquer altura a partir desta data.
5. Os códigos de desconto de campanhas ou promoções apresentados no site ou por email não são cumuláveis, podendo o cliente usar apenas 1 código de desconto por cada encomenda/ compra.
6. Os códigos de desconto enviados por email são ofertas pensadas de forma a premiar os clientes habituais. Desta forma, os mesmos são pessoais e intransmissíveis, e a empresa reserva o direito de negar a aceitação de códigos de desconto usados por clientes que não aqueles a quem o mesmo foi oferecido.

Campanha card oferta disponibilizada no Facebook "30% Desconto em Todos os Vinhos de Talha Naturais!": Oferta válida para todos os clientes; Desconto de 30% sobre todas as compras de vinho no site www.honrado.pt; A promoção apenas se aplica a compras iguais ou superiores a 2 garrafas de vinho; Os produtos das coleções Eventos, Enoturismo ou Packs de Natal não estão contempladas neste desconto; O cliente pode usar o código de desconto tantas vezes quanto quiser; A imagem é meramente ilustrativa, o vinho não será entregue com embrulhos de natal. 9 - Campanha "BLACKFRIDAY2022": Oferta válida para todos os clientes que receberam o desconto; Desconto de 20% sobre todas as compras de vinho no site www.honrado.pt e sub-domínio https//loja.honrado.pt; Os produtos das coleções Eventos, Enoturismo ou Packs de Natal não estão contempladas neste desconto; O cliente apenas pode usar o código de desconto uma vez; A imagem da campanha é meramente ilustrativa. ARTICLE 5 - SHIPPING COSTS
1. To the prices presented in Honrado are added the value of the postage of each order, which are calculated based on the weight of the order and its destination of delivery, the total of postage will be automatically calculated when making your order, these values may change without notice.
2. The value of the shipping costs can be simulated during the purchase process, with the desired products added and filling all the fields requested during this process.
ARTICLE 6 - DISPATCH OF ORDERS
1. As encomendas enviadas pela Honrado são entregues pela NACEX, podendo também ser entregues por outras empresas. As encomendas podem ser entregues na Europa, EUA, Canada, México e Brasil. Entre em contacto connosco através do email [email protected] para outros Países.
2. The products ordered from us Honrado are always delivered to the address that the Customer indicates when placing his order, and all information about the order is made available to the Customer in our order confirmation and shipping notifications.
3. A does Honrado not make deliveries in Apartments. If the Client indicates a PSTN as the delivery address, it will not be processed. In such cases he Honrado shall contact the Customer to change the delivery address in his registration details.
4. Todos os produtos enviados pela Honrado devem ser examinados pelo Cliente imediatamente aquando da sua receção. Se verificar que a sua encomenda se encontra danificada, deverá devolvê-la de imediato à empresa de transportes, justificando devidamente o motivo da devolução na guia de remessa/carta de porte e notificar de imediato a Honrado através do seguinte email [email protected]
5. A Honrado não se responsabiliza pelos envios feitos para países em que a respetiva lei não permita a entrada de bebidas alcoólicas, sendo da responsabilidade do Cliente a eventual apreensão da respetiva encomenda, bem como o pagamento de taxas aduaneiras, caso estas existam. No caso da devolução dos produtos a Honrado restituirá apenas o montante respetivo destes mesmos produtos. Em caso de dúvida contacte-nos antes de encomendar pelo email [email protected]
ARTICLE 7 - RETURNS
1. A Honrado recognizes to all its Clients the right of termination of contracts signed with it, under the terms of Article 10 of Decree-Law No. 24/2014 of 14 February, being the Client who should bear the costs of return. To do so, the Customer must return his order within a maximum of 14 days from the date of receipt by contacting us through the Contact Form on our website www.honrado.pt.
2. In the return order, the Customer is requested to indicate the order number or the number of the document that accompanied the order.
3. The returned products must be in perfect sales conditions, i.e. in the same condition in which they arrived in the hands of the Customer.
4. A Honrado accepts the exchange of any product purchased in its online store, which is contaminated or damaged, and for this purpose must return the bottle and stopper respective. The Company is Honrado responsible for the shipping and collection costs, whenever the Customer communicates this circumstance within a maximum of 14 days from the date of receipt.
5. Once the product has been received at our facilities and after validation of its status, its value will be returned and the refund will be made by the same means of payment that was used by the Client in the initial transaction or by bank transfer if the means of payment used does not allow it.
6. A does Honrado not accept the return of any product after use, or if it has been altered or modified.
ARTICLE 8 - WINE TASTING
The Parties agree that computerised records kept in the Parties' Honrado computerised systems shall be secure Wine Tasting for communications, orders and payments between the Parties.
ARTICLE 9 - CONSERVATION AND ARCHIVING OF TRANSACTIONS
Order filing and invoices will be made on a reliable and durable medium to correspond to a faithful and durable copy.
ARTICLE 10 - DATA PROTECTION
Whenever the collection of personal information is necessary for the availability of Online Store products, the use of this information will be made in compliance with the legislation applicable to the Data Protection Policy imposed by the CNPD (National Commission for Data Protection, in accordance with Decree No. 67/98 of 26 October, so as to ensure the confidentiality and security of personal data provided. ARTIGO 12 – LEI APLICÁVEL E FORO COMPETENTE
1. all purchases made in the company Honrado are subject to Portuguese law. To settle any and all disputes arising from any contract entered into under these general terms and conditions of online sales, Portuguese law shall apply and the courts shall have jurisdiction to settle disputes.
2. If the Customer is outside Continental Portugal, he hereby Honrado informs you that any legal proceedings should be exclusively brought in the Portuguese Courts.
3. Under the terms and for the purposes of Article 18 of Law 144/2015 of 8 September (ADR Law), we inform you that the ADR entity available is:
